It isn't for no reason that article 9 of statute of the Internati<?nal Criminal Court (ICC) deemed necessary elements of . crimes-genocide and ... - shall be adopted by a two - thirds majority of the members of the assembly of states parties. The aim of this article is study of those elements with respect the context of the CPPCG, proceedings of preparatory commission, the legal doctrine - before and after adoption of CPPCG - and finalized draft text of the Elements of Crimes that adopted in session of the members of the assmbly of states parties of I CC in Sep 2002. In this study, the important point is the correct understanding of the criminal conducts and mental element and criminal liability of perpetrator. The ingredients of mental element is a complicated problem, in particular distinction between the intent to destroy group and the motives of perpetration, that has been tried to solve. با گذشت بیش از 55 سال از امضای کنوانسیون منع و مجازات جنایت نسل زدایی هنوز بر سر موضوع ساختار عناصر این جرم اختلاف نظر وجود دارد.بی دلیل نیست که ماده 9 اساسنامه دادگاه بین المللی کیفری لازم دانسته است عناصر جرایم از جمله نسل زدایی با اکثریت دو سوم آرا اعضا مجمع دولت های متعاهد پذیرفته شود.موضوع این مقاله مطالعه عناصر مذکور است با در نظر گرفتن متن کنوانسیون منع و مجازات نسل زدایی صورت جلسات مذاکرات کمیسیون مقدماتی دکترین حقوقی قبل و بعد از تصویب کنوانسیون و لحاظ متن پیش نویس نهایی عناصر جرم که در سپتامبر سال 2002 میلادی د رجلسه اعضای مجمع دولت های متعاهد به تصویب رسیده است. در این بررسی نکته مهم درک درست اعمال مجرمانه عنصر روانی و در نتیجه مسئولیت کیفری مرتکب است.جزئیات عنصر روانی مساله پیچیده ای است به ویژه از حیث تمایز قصد نابودی گروه از انگیزه های ارتکاب نسل زدایی که تلاش شده حل گردد. https://jflps.ut.ac.ir/article_11194_a825d50ba967f2decc1fdd402575ea88.pdf
