Abstract

Parental tutelage is a kind of guardianship and mandate to take care of, protect and bring up children and the mentally deranged. The problem of parental tutelage and the priority of each parent for having custody of, and supervision over, their children arises
when the parents separate.
Muslim theologians disagre:e as to which parent is better qualified to be granted the 1tutelage of their young children. However, most of them believe that mothers are more competent for the tutelage of boys up to the age of two, and girld up to the
age of seven.
Apparently, parental tutelage is considered to be a right for
mothers and a right as well as a duty for fathers, for a mother is free to decide whether or not she is willing to breast - feed her child, but a father is obliged to take the responsibility of his child.
Some Muslim theologians have specified four, and some others six conditions for the parent who takes on the tutleage of a child.
