According to the second note of the new code of civil procedure, the compensation for the loss of orospective benefits shall not be awarded, although this note is absolute but it must be stipulated because, if a person seizes a property unlawfully, he will be liable for all of damages, including prospective benefits and
fruits.
In any case, as Iresearched, the claim of compensation for the loss of these speculation benefits shall be available though it isn't caused by unsurpation as stated by Islamic rule la-zarar (no damege and no loss in Islam).
