Abstract

There are two significant statutory texts on the liability of
physicians in current Iranian law, sections 319 and 322 of the
Islamic punishment Act. While the first text makes the physicians
strictly liable toward the patients, the second one permits him to escape from liability by mere an exemption clause.
In this essay, considering the precedence of these two sections in the Islamic jurisprudence, the extravagance of absolute liability and non-liability of physicians is adjusted and modified
