Abstract

For the first time in its history, the IC] tackled an issue which has threatened the future of humanity during the last 50 years. In its advisory opinion, the IC] concluded that neither customary nor
convertional international law contains any specific authorization or prohibition of the threat or use of nuclear weapons. In such a
situation, the IcJ announced that a threat or use of nuclear weapons is governed by the international law applicable in armed cont1ict. Moreover, the IC] unanimously called upon states to
pursue In good faith and bring to a conclusion negotiations leading to nuclear disarmament. The author will analyze Icj's
opinion and its implications for disarmament
